And also If they say give credit, do so. I get my pokemon pics from many sites, http://www.fireball20xl.com has a excellent sprite resource, and so does, http://www.pokemonelite2000.com. Mewtwofan's site also has a good sprites, I'll go find a link to that real quick...

I think I have a bigger problem than that, though. If I use any of Nintendo's pictures on a site that earns me money, won't they not allow me to use them, no matter which site I get their pictures from?

And by the way ShadowFlygon, do those sites you mention above require that you say on your site that your pictures are from their site, or did you have to obtain permission from them to use those pictures, or did they say that they're free for all to use?

Not 100% on US Law but I'm pretty sure you cannot profiteer of copyrighted material. I can't say wether they will sue you or not because I have nothing to do with their legal department.

Why take the risk? If you think that you're going to make a lot of money off a Pokemon website, it's going to have to be a damn good one.

I personally wouldnt waste my time earning money which a company could easily seek a court order to hand over all your profits to them. You're basically making money for them.

Just a question -- If you don't make money off a site, NPO, that is, are you allowed to use images? Don't have any images I want to use for my school forum, it was just a thought.

I'm pretty sure you can use images if you don't make profit. That would fall under the category of a fan site (like this one and most of the others) and it's pretty much okay.

Psypoke make no money off the site - we don't even generate revenue at all let alone profit. We're hosted on gamespy, and we display gamespy ads on our site as part of our agreement with them, and in return, we don't have to pay anything.

As an example, say Nintendo wanted to take us to court for breach of copyright. However the thing is, they could only sue us for a return of profits...and we make $0 profit. So they would have paid their lawyers, and gotten nothing out of us.

Also, the negative publicity they would have drawn to themselves would have been terribly damaging to their reputation. Some of you might have heard about the RIAA vs. 12 year old girl case, where the RIAA took a girl to court for downloading music. You simply don't do stuff like that. It'd be similar for Nintendo - the headlines would be something like "Nintendo sues fansite for nothing". If the court ruled in their favour, it would mean every company would be able to sue any fansite because courts are bound by their previous decisions, and the precedent would have huge implications - nearly all fansites of anything would have to close down. This would essentially be shooting themselves in the foot, because fansites create hype, and keep people interested in their products. If every fansite closed down, many would stop buying Nintendo products and they would suffer a huge loss.

However if we did use their copyrighted material to make a profit, it'd be a different story, they'd simply seek an injunction and return of profits and nobody would hear a thing about it.

So that's basically the legal rundown, hope this helps you guys out...but just remember, big companies do have big money to pay for lawyers to get their profits back. Individuals trying to profit off their ideas are pretty much screwed :S

Although I'm sure Nintendo might allow me to do it if I cut them in on a portion of my profits. After all, I'm paying how much a year for a domain name, so I need to make some money to cover that cost, plus make a slight profit at the same time.
